AGREEMENT TO TERMS
These Terms of Use (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Tru-Bilt Farm & Commercial Building Company, LLC (“Tru-Bilt,” “we,” “us,” or “our”), concerning your access to and use of the https://www.webuildtru.com/ & https://www.tru-bilt.co websites as well as any other media form, channel, mobile website, or application related, linked, or otherwise connected to it (collectively, the “Site”).
By accessing the Site, you agree that you have read, understood, and accepted these Terms of Use. IF YOU DO NOT AGREE, you are expressly prohibited from using the Site and must discontinue use immediately.

Supplemental terms, policies, or documents that may be posted on the Site from time to time are incorporated herein by reference. Tru-Bilt reserves the right, in its sole discretion, to modify or update these Terms of Use at any time and for any reason. We will update the “Last Updated” date at the top of this page when revisions are made. You are responsible for reviewing these Terms regularly. Continued use of the Site after revisions are posted constitutes acceptance of the updated Terms.
2. Eligibility and Geographic Restrictions

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
11. Dispute Resolution
Any disputes arising under these Terms shall be brought exclusively in the state or federal courts located in Marion County, Illinois, and the parties consent to personal jurisdiction and venue in those courts.
12. Disclaimer
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TRU-BILT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO GUARANTEES ABOUT THE ACCURACY OR COMPLETENESS OF SITE CONTENT AND ARE NOT RESPONSIBLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SITE.
13. Limitation of Liability
IN NO EVENT SHALL TRU-BILT OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14. Indemnification

16. Miscellaneous
These Terms, together with our Privacy Policy and any other posted policies, constitute the entire agreement between you and Tru-Bilt. If any provision is found unenforceable, the remaining provisions shall remain in effect. Tru-Bilt’s failure to enforce any right or provision shall not be deemed a waiver of such right or provision.
